Your walk-in cooler dies on a Friday. Forty thousand dollars to replace it. Your bank wants two years of tax returns and six weeks to think about it. A merchant cash advance company wires the money Tuesday.
You pay for that Tuesday. Sometimes it’s worth it.
What Is a Merchant Cash Advance?
It’s a sale, not a loan. The funder https://www.gofundshop.com/ hands you a lump sum today and buys a slice of your future card sales until they’ve collected an agreed total.
That wording matters more than it sounds. Because merchant cash advance loans aren’t legally loans, state usury caps mostly don’t apply, most funders skip the business credit bureaus, and nobody needs a lending license. Every contract calls itself a “purchase and sale of future receivables.” There’s a reason for that.
The flip side: if it’s really a purchase of sales, then repayment has to move with your sales. Slow month, smaller collection. A real agreement includes a reconciliation clause so you can ask for an adjustment when revenue drops. Fixed daily payment, no reconciliation? Courts in New York and Connecticut have looked at contracts like that and called them what they are: usurious loans in a costume.
Merchant Cash Advance: How It Works
Step one. You get a purchase price. Call it $50,000.
Step two. The funder sets a factor rate, usually between 1.15 and 1.50. At 1.35 you owe $67,500. That number is frozen the day you sign. Paying early buys you nothing unless your contract spells out a prepayment discount, and most don’t.
Step three. They set a holdback, typically 8% to 20% of daily card sales. Do $100,000 a month on cards with a 10% holdback and about $10,000 walks out of your account every month.
Step four. Collection starts almost immediately, one of three ways:
ACH debit, pulled from your operating account daily or weekly
Split funding, where your processor divides each batch and routes the holdback straight to the funder
Lockbox, where all your card money lands in an account the funder controls and they forward your share, usually a day late
Step five. It stops when they’ve collected the full $67,500. At $10,000 a month, that’s roughly six and three-quarter months.
How Does Merchant Cash Advance Work on Cost?
The factor rate is where people get fooled. A 1.35 factor reads like 35% interest. It isn’t close.
You never hold that $50,000 for a year. Repayment starts on day one, so your average balance across the term is closer to $25,000. Now you’re paying $17,500 to use about $25,000 for under seven months. Annualize that and you’re past 100%. Across the industry, effective APRs run from roughly 40% on the cheapest deals to over 300% on short ones with fat factors.
The cruel part: a good month makes it worse. If sales jump and you clear the $67,500 in four months instead of seven, you pay the same dollars over less time. Your APR nearly doubles for the crime of doing well.
Merchant Cash Advance Requirements
Underwriters read your bank statements, not your credit report. What they want:
Three to six months in business. Some funders hold out for a full year.
Ten to fifteen thousand a month in card sales or total deposits, as a floor.
Three to six months of bank statements. This is the whole ballgame. They’re counting negative days, checking your average daily balance, and looking for debits that reveal advances you already have.
A 500 credit score, give or take. Plenty of funders don’t set a floor.
Processor statements, if the deal splits at the batch level.
No open bankruptcy, and usually no more than one or two advances already running.
Approval lands inside 24 hours. Money follows in one to three business days. That speed is the entire product.
Read These Clauses before Anything Else
Personal guarantee of performance. Almost every contract has one. It’s narrower than a full personal guarantee, since it usually covers fraud, breach, or closing the doors to dodge remittance rather than plain bad luck. Read the scope anyway. It varies wildly between funders, and it’s the hook that gets them to your house.
Reconciliation. Does it exist? Automatic, or do you have to file a written request inside a 5-day window with documents you’ll never assemble in time? Some contracts allow one reconciliation a month and bury the procedure on page nine. Understanding this provision is especially important when comparing MCA business loans, as reconciliation policies can significantly affect your repayment obligations.
Default triggers. Switching processors can be default. Opening a second advance can be default. Letting the account go negative can be default. Default usually means the whole uncollected balance comes due at once.
Stacking bans. Taking a second advance on top of the first violates most agreements, and it’s how businesses die. Two holdbacks on one revenue stream can eat 30% of daily sales before you’ve paid a supplier.

The window where an advance makes sense is narrow. You have card volume, you need cash now, the bank said no, and the money earns back more than it costs. A cooler that reopens your restaurant clears that bar on Tuesday afternoon. A marketing experiment does not.
What the Regulators Did?
California’s SB 1235 kicked in December 2022 and forces funders to disclose an estimated APR. New York’s Commercial Finance Disclosure Law followed on August 1, 2023. Utah, Virginia, and Georgia wrote their own. In those states you should get an APR in writing. Find it. It’s the only figure in the packet you can compare to anything else.
Confessions of judgment used to be standard here. They let a funder walk into court and take a judgment against you with no hearing. New York banned their use against out-of-state debtors in 2019, after Bloomberg reporters counted thousands filed against small businesses. They still show up in contracts. See one, walk out.
The FTC has gone after funders for lying about terms, too. Its case against RCG Advances ended in a settlement worth $2.7 million in redress plus cancellation of outstanding debt.
Do This Math First
Advance times factor rate. That’s your total.
Total divided by (monthly card volume times holdback). That’s your term in months.
Now picture your business with that holdback missing from every single deposit for that many months.
If step three makes payroll sweat, the advance isn’t fixing your cash flow. It’s charging you triple digits to postpone the same conversation.
